MTN Ghana seeking review of market dominance restrictions

MTN Ghana will request a judicial review of its recent classification as a Significant Market Power by the National Communication Authority (NCA).

In early June, the regulator deemed MTN Ghana’s market dominance to be of a sufficient level that specific regulatory restrictions should be enforced on the operator.

While the operator stated that it understands the regulator has both the duty to maintain fair competition and accordingly the powers to encourage this, it argues “the manner of the recent declaration of MTN as a Dominant/SMP player raises concerns about clear procedural breaches and substantive issues.”

The operator has hit out against the regulator’s findings, noting that it is not “aware of any industry economics/market study to establish market failure” in Ghana. Additionally, it describes itself as “a responsible and ethical leader” that has never “engaged in an anti-competitive behaviour.”
